1. Agreement to Terms
By accessing or using BigTB.ai (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you (“Customer”) and BigTB (“Company,” “we,” “us”).
2. Service Description
BigTB.ai provides managed cPanel hosting workspaces optimized for AI-assisted development. The Service includes:
- cPanel hosting accounts with PHP, MySQL, SSL, SSH, and email
- AI workflow guides and documentation for coding tools
- Access to the HQ/Learning Zone and weekly training sessions
- Optional billable engineering support through the Support Marketplace
The Service is designed for builders using AI coding tools (Claude Code, Cursor, GitHub Copilot, etc.) to create and deploy web applications.
3. Acceptable Use Policy
You agree not to use the Service for any of the following:
- Sending unsolicited bulk email (spam) or operating mailing lists without proper opt-in
- Hosting, distributing, or linking to malware, viruses, or malicious code
- Phishing, social engineering, or impersonation of any person or entity
- Hosting content that is illegal under United States or Nevada state law
- Copyright infringement or hosting pirated content
- Cryptocurrency mining or other resource-abusive computational tasks
- Port scanning, network probing, or attacking other systems
- Operating open proxies, relay servers, or TOR exit nodes
- Intentionally consuming resources beyond your plan limits to degrade service for others
Enforcement
Violations are handled progressively: written warning, temporary suspension, then permanent termination. Severe violations (malware, phishing, illegal content) may result in immediate suspension without warning. We will make reasonable efforts to notify you before any enforcement action.
4. Account Terms
- You must provide accurate, complete registration and billing information.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must be at least 18 years of age to use the Service.
- One person or legal entity per account. Accounts are not transferable.
5. Payment & Billing
All hosting plans are billed monthly in advance via Stripe or PayPal. Plans auto-renew at the end of each billing cycle unless cancelled.
If a payment fails, we will attempt to charge the payment method on file for up to 7 days. If payment is not received within this grace period, your account may be suspended. You will receive email notification before any suspension.
Prices are listed in USD. Applicable taxes may apply based on your jurisdiction.
6. Refund Policy
First payment: 14-day money-back guarantee. If you are not satisfied within the first 14 days of your initial subscription, contact us for a full refund.
Subsequent payments: After the first 14 days, cancellations result in prorated account credit for the remaining billing period. No cash refunds on subsequent payments.
Support Marketplace: Billable engineering sessions are non-refundable once the session has been initiated.
7. Service Level Agreement
We target 99.9% uptime for all hosting accounts, measured monthly excluding scheduled maintenance (announced at least 24 hours in advance).
Credits: For each 30 minutes of unscheduled downtime beyond the 99.9% threshold, you are eligible for a credit of 5% of your monthly hosting fee, capped at 50% of your monthly fee. Credits must be requested within 30 days of the incident via email to support@bigtb.ai.
This SLA does not apply to downtime caused by: factors outside our reasonable control, your actions or inactions, third-party services, or scheduled maintenance.
8. Data Handling
Your data is yours. We do not access, review, or use customer-hosted content except when:
- You explicitly request support and grant access
- Required by law or valid legal process
- Investigating a violation of these Terms (abuse, malware, etc.)
On cancellation: You have 30 days from account cancellation to export your data. After the 30-day window, all account data (files, databases, email) will be permanently deleted.
9. Account Suspension & Termination
We may suspend or terminate your account for:
- Violation of these Terms or the Acceptable Use Policy
- Non-payment after the 7-day grace period
- Activity that threatens the security or performance of the platform
Except in cases of severe violation, we will provide at least 48 hours' notice before termination. Upon termination, the 30-day data export window applies.
10. Service Modifications
We may modify plans, features, or pricing with 30 days' written notice. Existing customers are grandfathered at their current pricing for the remainder of their active billing cycle. Material changes to these Terms will be communicated via email.
11. Intellectual Property
You retain all rights to code, content, and data you create or upload to the Service. BigTB retains all rights to the platform, branding, documentation, and proprietary tools.
Nothing in these Terms transfers ownership of intellectual property from either party to the other.
12. Limitation of Liability
In no event shall BigTB be liable for damages exceeding a customer's monthly payment amount. BigTB is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.
BigTB provides the Service on a good-faith, best-effort basis. We do not guarantee 100% uptime or uninterrupted service. Some features rely on third-party vendors, and BigTB is not responsible for failures or changes in those external services.
13. Right to Refuse Service
BigTB reserves the right to refuse service to any individual or entity for abuse of the platform or for good cause as determined by BigTB in its reasonable discretion.
14. Indemnification
You agree to indemnify and hold harmless BigTB, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms. This includes liability for the actions of any representatives, employees, or agents acting on your behalf, including compliance failures by such representatives.
15. Governing Law
This Agreement shall be governed by and construed under the laws of the State of Nevada, without regard for the principles of conflicts of law. Any litigation arising from this Agreement shall only be brought in utmost good faith, having exhausted all reasonable efforts to reconcile, and only with the Duty to Limit Expenses associated with litigation.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and BigTB regarding the Service. They supersede all prior understandings, agreements, or representations. Modifications to these Terms require written signatures from both parties, except for updates made in accordance with Section 10.
